1. GENERAL PART

 

1. USER DATA COLLECTION AND PROCESSING

Within the scope of the website hosted at www.ftcarvalho.com (“Site”) including the provision of information about their services and communications made available, Fábrica de Tecidos do Carvalho, Lda. (“Fábrica de Tecidos do Carvalho”), with the corporate taxpayer number 500107815, with its registered office at Estrada Nacional 105, Nº 991 4815-158 Guimarães, may require the User to provide personal data, that means any information that allows Fábrica de Tecidos do Carvalho to identified and contact the User (“Personal Data”).  
The Personal Data collected and processed consists of information regarding the name, email address, and other personal information provided by the User.
When collecting Personal Data directly, Fábrica de Tecidos do Carvalho provides the data subject with detailed information about the nature of the data collected and about the purpose and processing that will be carried out in relation to the Personal Data, through the consultation of this Privacy Policy.

• The User has given consent to the processing of his or her personal data for one or more specific purposes;

The processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

• The processing is necessary for compliance with a legal obligation to which Fábrica de Tecidos do Carvalho is subject;

6. TRANSFERS OF PERSONAL DATA TO THIRD COUNTRIES (OUTSIDE THE EUROPEAN UNION)

Personal data collected and used by Fábrica de Tecidos do Carvalho is not made available to third parties established outside the European Union. If, in the future, such a transfer takes place for the reasons mentioned above, Fábrica de Tecidos do Carvalho undertakes to ensure that the transfer complies with the applicable legal provisions, regarding the country’s adequacy decision with respect to data protection and the requirements applicable to such transfers.

8. PROCEDURES FOR THE EXERCISING OF USERS RIGHTS

The right of access, rectification, erasure, restriction of processing, to object and to data portability can be exercised by the User through the e-mail dpo@ftcarvalho.com. 
Fábrica de Tecidos do Carvalho will respond in writing (including by electronic means) to the User’s request within a maximum period of one month from the receipt of the request, except in particularly complex cases, for which this period may be extended up to two months.
Where requests are manifestly unfounded or excessive, in particular because of their repetitive character, Fábrica de Tecidos do Carvalho may charge a reasonable fee based on administrative costs, or refuse to act on the request.

9. DATA BREACH

When the personal data breach is likely to result in a high risk to the rights and freedoms of natural persons, Fábrica de Tecidos do Carvalho shall communicate the personal data breach to the User, not later than 72 hours after having become aware of it.
In legal terms, the communication to the User shall not be required if any of the following conditions are met:

In the case of adjustment to the Privacy Policy, the date of the most recent change will be available at the top of this page. If the change is substantial, a notice will be placed on the website.
 

11. APPLICABLE LAW AND LEGAL JURISDICTION

The Privacy Policy, as well as the collection, processing or transmission of User Data are all governed by the provisions of EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, and by the laws and regulations applicable in Portugal.
Any litigation arising from the validity, interpretation or implementation of the Privacy Policy, or related to the collection, processing or transmission of User Data, must be submitted exclusively to the jurisdiction of the courts of Fábrica de Tecidos do Carvalho, without prejudice to mandatory legal rules.
